Introduction
This privacy notice applies to the personal data that may be collected or used by Koninklijke Philips N.V., Respiratory Technologies, Inc. (“RespirTech”), or their affiliates (collectively referred to as “Philips”). This Privacy Notice provides you with information regarding Philips’ collection, use and disclosure of the personal data processed through the RespirTech.com website, referred to on this site as RespirTech®, and its related marketing, sales and customer service activities, which may occur via contracted third party services. This is a notice about our privacy practices; it is not a contract or agreement.
How your Personal Data is collected and used
Contacting Customer Service
Philips will record your personal data whenever you contact our Customer Care Support Center which you may do by submitting an inquiry via an online form, or calling us directly. Philips will record your contact information (such as name, phone number, and email), your question or request, the date and time and means of the contact (e.g. telephone call, on-line web form, email, etc.) and any other data relevant to your question or request.
As part of our commitment to providing the best possible service to our customers, we might record telephone calls answered in our Customer Care Support Centers. We will notify you in advance if your telephone call is recorded. We may use the recording to:
- Help us improve the quality of our customer service, by using information obtained from recorded calls to aid in developing training content and conducting staff training to ensure the information we provide is consistent and accurate;
- Produce analytics for reporting purposes related to the types and numbers of inquiries we receive to find ways to simplify our service to you; and
- Ensure we have an accurate record of your call, which may be needed to support any transactions that take place over the phone, or to manage our business.
In your interactions with Philips we will not request any sensitive data (e.g. health data) unless specifically relevant to your question or request. We ask that you not provide this kind of information during your interactions with Philips.
If needed during our interface with you, any data collected will primarily be used for contacting you to answering your question or for the resolution of your request.
Marketing
If you submit an online form to request marketing materials, or product information, your data will be used to provide you the requested materials. If you provide a phone number or email, it may be used to confirm receipt of your request, or verify an address. This information will not be used for any reason other than that outlined on the form where you make your request.
Share your story submission
Should you choose to submit a product experience or testimonial via the form found on our website, Philips will ask for your name, address, email and phone number for the purposes of validating your story and story attribution. All story submissions require you to also review and agree to the terms outlining how your story may be used by Philips. Please consider what information you share and only provide details on that information of which you are comfortable. Submissions may be used as outlined in the terms provided on the website.
Event registration
RespirTech may collect data for professional events, webinars or fairs ("Events") that you may wish to attend and register for via the website. When you register for an event, we will process your business contact information (name, email, business address) and may require the additional following information:
- Specialty
- Facility
- Modality
- Products interested
- Date
- Time slot
- Business phone
- Relevant dietary information.
By registering to an event, you are agreeing to receive communications from Philips directly related to the event, such as what location the event will be hosted, what time the event takes place.
If you choose to scan RespirTech's QR code during an event to obtain our marketing materials, you are agreeing to provide your contact information, which may include the information below, so that we may follow up with you on any inquiries you may have.

Cookies
The RespirTech.com website collects information through cookies or similar techniques regarding your use of the website.
- This data will be used to track your use of the website, such as identifying which parts of the website you are interested in, where you spend more time, or engage by clicking on content. This can help us make decisions on what content to provide on the website, or may be used to improve the website experience.
- If you’ve clicked through to the website as a result of a marketing campaign, we will record that action and further engagement with the site to inform future marketing communications and strategy.
- We also make use of cookies that ensure that the website functions properly.
Personal Data shared with Third Parties
Philips may use trusted third parties to provide certain services for RespirTech.com. Such services may include the processing of personal data, including for the following:
• IT Providers
These providers deliver the necessary hardware, software, networking, storage, transactional services and/or related technology required to run the website and related business processes to provide you with the service requested.
• Cloud Providers
These providers deliver specific services for sending and receiving data between data centers/cloud repositories using secure electronic transfer methods.
Philips requires these service providers to provide a comparable level of protection of your personal data as Philips provides, to only process your personal data for the specific purposes mentioned above, to limit access to the minimum amount of data needed to deliver a specific service, and to require the same of their subcontractors who support them in providing services to Philips.
If Philips allows a third party to transfer your personal data outside of your geographic region, we will take steps to protect your privacy rights through the use of contractual arrangements or other means, which will provide a comparable level of protection while the information is being processed by our third parties.
Philips will disclose personal data only under this privacy notice and/or as required by law.
Philips sometimes sells a business or a part of a business to another company. Such a transfer of ownership could include the transfer of your personal data directly related to that business, to the purchasing company.
Choices and rights
If you would like to submit a request to access, rectify, erase, restrict or object to the processing of personal data that you have previously provided to us, or if you would like to submit a request to receive an electronic copy of your personal data for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law), you may contact us at privacy@philips.com. We will respond to your request consistent with applicable law.
In your request, please make clear what personal data you would like to have changed, whether you would like to have your personal data suppressed from our database, or otherwise let us know what limitations you would like to put on our use of your personal data. For your protection, we may only implement requests with respect to the personal data associated with your account, your email address or other account information that you use to send us your request, and we may need to verify your identity before implementing your request.
Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g. when you make a purchase or enter a promotion, you may not be able to change or delete the personal data provided until after the completing of such a purchase or promotion). There may also be residual information that will remain within our databases and other records, which will not be removed.
We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt out.
If you make use of (some of) your choices and rights, you may not be able to use, in whole or in part, certain Philips Services.
We protect your personal data
We recognize and take seriously our responsibility to protect the data you entrust to Philips from loss, misuse or unauthorized access. Philips uses a variety of security technologies and organizational procedures to help protect your data. For example, we implement access controls, use firewalls, use encryption and use secure servers.
Special information for parents
While the Respirtech.com website is not directed to children, as defined under applicable law, and we do not knowingly collect personal data from children. It is, however, our policy to comply with the law when it requires parent or guardian permission before collecting, using or disclosing personal data of children. We are committed to protecting the privacy needs of children and we strongly encourage parents and guardians to take an active role in their children's online activities and interests.
If a parent or guardian becomes aware that his or her child has provided us with his or her personal data without their consent, please contact us at privacy@philips.com. If we become aware that a child has provided us with personal data, we will delete his/her data from our files.
Linking to other websites
During your online journey across RespirTech.com or other Philips websites, you may encounter links to other websites for your convenience and information. These websites may operate independently and may have their own privacy notices, statements or policies. We strongly suggest that you review them to understand how your personal data may be processed in connection with those sites, as we are not responsible for the content of non-Philips-owned or managed sites, or the use or privacy practices of those sites.
Changes to this Privacy Notice
The services that Philips provides may change from time to time without prior notice to you. For this reason, we reserve the right to change or add to this Privacy Notice from time to time.
We encourage you to check back often to review the latest version.
The new Privacy Notice will be effective upon posting, if you do not agree to the revised notice you should not visit the website. By continuing to access or make use of the website after those changes become effective, you acknowledge you have been informed of the changes and have reviewed the revised Privacy Notice.

Additional information for California Residents
California Civil Code Section 1798.83 permits our customers who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. Individual Rights and Requests
If you are a California resident, you may request that we:
- Disclose to you the following information covering the 12 months preceding your request:
- The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information;
- The specific pieces of Personal Information we collected about you;
- The business or commercial purpose for collecting (if applicable) Personal Information about you; and
- The categories of Personal Information about you that we otherwise shared or disclosed, and the categories of third parties with whom we shared or to whom we disclosed such Personal Information (if applicable).
- Delete Personal Information we collected from you.
To make a request for the disclosures or deletion described above, please contact us at contact form or 866-309-3263. We will verify and respond to your request as described above in “Your Rights and Choices Available to You” and consistent with applicable law, taking into account the type and sensitivity of the Personal Information subject to the request. We may need to request additional Personal Information from you, such as email address, mailing address and telephone number in order to verify your identity and protect against fraudulent requests. If you make a deletion request, we may ask you to verify your request before we delete your Personal Information.
You have the right to be free from unlawful discrimination for exercising your rights under the CCPA.
Authorized Agents
If you want to make a request as an authorized agent on behalf of a California resident, you may use the submission methods noted above. As part of our verification process, we may request that you provide, as applicable:
- Proof of your registration with the California Secretary of State to conduct business in California;
- A power of attorney from the California resident pursuant to Probate Code sections 4000-4465;
- Written permission that the California resident has authorized you to make a request on the resident’s behalf. This permission must be signed (via physical or e-signature) by the California resident.
If you are making a request on behalf of a California resident and have not provided us with a power of attorney from the resident pursuant to Probate Code sections 4000-4465, we may also require the resident to:
- Provide you with a written permission signed by the resident to make the request on the resident’s behalf;
- Verify the resident’s own identity directly with us;
- Directly confirm with us that the resident provided you permission to submit the request.
